Terms of Service
These Terms of Service ("Terms") form a binding agreement between you and Hydromation Corporation ("Hydromation," "we," "us," or "our"), the operator of EmpowerMyCare (the "Service"). Please read these Terms carefully. By creating an account, checking the consent box at sign-up, or using the Service, you agree to these Terms.
1. The Service, in plain English
EmpowerMyCare is a consumer-facing personal health management tool. It helps individuals and the family members, friends, and paid non-medical caregivers they choose track medications, appointments, providers, insurance, tasks, notes, and documents related to their own health.
EmpowerMyCare is not a healthcare provider, a medical device, a pharmacy, an insurer, or a HIPAA-covered health service. We do not practice medicine. We do not provide medical advice. We do not have any relationship with your doctors, your insurance company, or any hospital, clinic, or health plan. We do not accept referrals or data feeds from healthcare providers or payers. We are a personal record-keeping and coordination tool that you operate for your own benefit.
2. Who may use EmpowerMyCare
You must be at least 18 years old and legally able to enter into this agreement. EmpowerMyCare is intended for individuals managing their own health ("Patient Account Owners") and the people they personally designate to help them ("Care Team Members"). EmpowerMyCare is not intended for, and may not be purchased or used by, any covered entity under HIPAA — including healthcare providers, hospitals, clinics, health plans, insurers, clearinghouses, or any business associate acting on their behalf — for the purpose of managing protected health information on behalf of patients. If you represent such an organization, do not create an account.
3. Your account and your data
You control your account. You decide what information to enter, what documents to upload, and who you invite to your Care Team. You are responsible for the accuracy of what you enter and for keeping your credentials confidential. You are responsible for all activity under your account. Notify us immediately at support@empowermycare.net if you suspect unauthorized access.
4. Care Team access
The Care Team feature lets you invite other people to view or help manage your account in one of the following roles: Owner, Co-Manager, Active Caregiver, View-Only, or Task Helper (paid non-medical caregiver). Each role grants a different scope of access. You can revoke any Care Team Member's access at any time from the Care Team page. No access to your account is granted to anyone — including any healthcare provider, clinic, hospital, insurer, or third-party organization — unless you personally invite them. Hydromation will never grant or sell account access to any third party.
5. If you are signing up as a caregiver for another person
If you create an account on behalf of another adult (for example, a parent, spouse, or client), you represent and warrant that you have the legal authority to do so — as a holder of a valid power of attorney, healthcare proxy, court-appointed guardianship, or with the documented and informed consent of the individual. You further represent that any information you enter or upload about that individual is entered with their authority. You, not Hydromation, are responsible for ensuring that your authority is valid and lawful in your jurisdiction. If your authority ends (for example, a power of attorney is revoked or the individual passes away), you will notify us at support@empowermycare.net and stop using the account.
6. Acceptable use
You agree not to: (a) upload or enter information about any person without authority to do so; (b) use the Service to solicit medical care, diagnose, or treat any condition; (c) attempt to extract, scrape, reverse-engineer, or resell the Service or its content; (d) interfere with, probe, or disrupt the Service or its infrastructure; (e) use the Service to violate any law, including laws governing health information, privacy, consumer protection, or data security; (f) upload malicious code; (g) impersonate any other person; or (h) use the Service to provide services to a HIPAA-covered entity without our written agreement.
7. Subscription, free trial, free tier, and billing
EmpowerMyCare offers a 14-day free trial with no credit card required. After the trial, if you do not subscribe, your account moves to our permanent free tier — your data is preserved and you can continue using core care-coordination features. Our paid subscription is $10/month, billed monthly, and includes full access to all paid features for one patient account along with unlimited invited Care Team Members. Paid subscriptions auto-renew monthly until cancelled. You may cancel at any time from the Settings page; cancellation takes effect at the end of the current billing period and you will not be charged again. We do not offer refunds for partial billing periods. Prices are in U.S. dollars and may change; we will give at least 30 days' notice by email and in-app notice of any price change before it takes effect on your account. Promo codes and complimentary accounts may be offered at our discretion and may be revoked if the terms of the specific promotion are not met.
8. Your content, our content
You own the information, documents, photos, and notes you upload or enter ("Your Content"). You grant Hydromation a limited, non-exclusive license to store, process, transmit, and display Your Content solely for the purpose of providing the Service to you and the Care Team Members you authorize. We do not use Your Content to train artificial intelligence models. We do not sell Your Content. We do not use Your Content for advertising. The Service itself, including its software, design, and branding, is owned by Hydromation and licensed to you for personal, non-commercial use while your account is active.
9. Service providers
We rely on a small number of reputable service providers to operate the Service. These providers process Your Content only as needed to deliver functionality and are bound by contract to appropriate data protection obligations. Current sub-processors are listed in the Privacy Policy and include, as of the date of these Terms, Anthropic (for the Ask Liz AI assistant), Supabase (for account and data storage), and Netlify (for web application hosting). We will update the Privacy Policy when the list changes.
10. Medical disclaimer (summary)
The Service, including the Ask Liz AI assistant and any drug interaction information, is for organizational and informational purposes only. It does not constitute medical advice, a medical opinion, a prescription, a diagnosis, or treatment. Always consult a qualified healthcare professional for medical decisions. 11. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including without limitation implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure against every possible attack, nor that drug interaction information or AI-generated content will be accurate, complete, or suitable for any particular purpose.
12. Limitation of liability
To the maximum extent permitted by law, Hydromation and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, use, goodwill, or medical outcomes, arising from or related to your use of the Service, even if advised of the possibility of such damages. Our total aggregate liability for any claim arising out of or related to the Service will not exceed the greater of (a) the amount you paid Hydromation for the Service in the twelve months preceding the claim or (b) one hundred U.S. dollars ($100).
13. Indemnification
You agree to indemnify and hold harmless Hydromation, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any law or the rights of any third party, including any individual whose information you entered or uploaded; or (d) any content you submit through the Service.
14. Dispute resolution and binding arbitration
Please read this section carefully — it affects your legal rights. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except that you may assert claims in small claims court if your claims qualify. The arbitration will take place in Loudoun County, Virginia, or, at your election, by telephone or online. The arbitrator's decision will be final and enforceable in any court of competent jurisdiction. Each party will bear its own costs except as the AAA rules or applicable law require otherwise.
15. Class action waiver
You and Hydromation agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.
16. Opt-out of arbitration
You may opt out of the arbitration agreement and class action waiver in Sections 14–15 by sending written notice to legal@empowermycare.net within 30 days of first accepting these Terms. Your notice must include your full name, account email, and an unambiguous statement that you wish to opt out. Opting out will not affect the other provisions of these Terms.
17. Governing law and venue
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict of laws rules. For any matter not subject to arbitration, you and Hydromation agree to the exclusive jurisdiction of the state and federal courts located in Loudoun County, Virginia.
18. Termination
You may delete your account at any time from the Settings page. We may suspend or terminate your account if you violate these Terms, if your payment fails, or if we are required to by law. On termination, your data is permanently deleted within 30 days unless a longer period is required by law. Sections that by their nature should survive termination (including Sections 8, 11–17, and 19) will survive.
19. Changes to these Terms
We may update these Terms from time to time. If the changes are material, we will notify you by email and by in-app notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance. If you do not agree to the updated Terms, you may cancel your subscription and delete your account.
